THE OPPORTUNITY

This position provides leadership-level transactional legal support to the Company's Development department, including the Real Estate, Lease Administration, Asset Management, Construction and Facilities teams, and supports regulatory and operational issues related thereto. The successful candidate must have the ability to identify and analyze complex legal issues and present appropriate recommendations to minimize the legal exposure of the Company in its real estate transactions and holdings.   The successful candidate must also have the ability to assemble, coordinate and lead teams of outside counsel and in-house attorneys and paralegals to staff the Company's real estate-related legal needs, as well as to draft and negotiate a variety of agreements including, without limitation retail leases, construction agreements, and related documentation.


WHAT YOU’LL DO

  • Provides advice and counsel related to real estate due diligence, site selection, LOIs and related new restaurant opening activities.
  • Leads negotiation and drafting of a portion of the Company's new restaurant leases and related agreements, including work letters and other design and construction-related documentation.
  • Selects, manages and provides oversight of outside counsel providing legal services for new restaurant leases and related agreements, design and construction-related documentation, and other real estate-related transactions and agreements.
  • Performs or assigns, and provides oversight of and input with respect to, legal review of additional real estate-related documentation, including lease renewals, financing-related documents, contractor agreements, architect agreements, and brokerage agreements, etc.
  • Performs or assigns, and provides oversight of and input with respect to, legal review of additional real estate-related documentation, including lease renewals, financing-related documents, contractor agreements, architect agreements, and brokerage agreements, etc.
  • Manages the legal processes and procedures of the Company's Development department, including the Real Estate, Lease Administration, Asset Management, Design, Construction and Facilities teams, ensuring the delivery of timely and cost-effective legal advice and the coordination of other team resources in order to facilitate achievement of Development team's business goals.
  • Retains, monitors, and evaluates the performance of outside counsel providing real estate services.
  • Provides oversight, advice and counsel to, and arranges development opportunities for, members of the Legal Department's real estate team.
  • Provide support on real estate disputes and litigation matters.
  • Compiles, prepares, and presents budget recommendations for area of responsibility and manages budget for same.
  • Ensures that real estate-related regulatory issues are successfully addressed in a way that avoids adverse impact on the Company's business.

WHAT YOU’LL BRING TO THE TABLE

  • JD from accredited law school
  • 8+ years of experience in a combination of real estate law in a reputable law firm, and in-house experience, ideally in a restaurant or other retail environment.
  • Bar passage and qualification to practice in Ohio. Executive presence and strong communication, presentation and interpersonal skills. Must be able to prepare and present to diverse audiences.
  • Ability to effectively collaborate cross-functionally, juggle conflicting demands and prioritize deadlines
  • Ability to handle and manage significant number of leasing deals simultaneously, coordinate with design and construction teams and meet store buildout timelines.
  • Working knowledge of information technology platforms, real estate-related solutions and records retention practice.
  • Ability to demonstrate broad and comprehensive knowledge of real estate concepts, practices and policies with the ability to use them in complex situations across multiple functional areas.
  • Leadership and expert communication skills to influence, advocate for and drive change and compliance across a global company.
  • Strong business acumen and practical approach to problem solving is required.
